1. General

These Terms and Conditions of Service ("TCS") govern the use of services provided by KUTECH 101 S.L. through the platform accessible at [optimizatucv.es] (the "Site"), including but not limited to the analysis and tailoring of CVs to job postings (the "Services").

By using the Site or the Services, you agree to these TCS. If you do not agree, do not use the Site or the Services.

2. Access to Services and Account Creation

a. Who the Services Are For

The Services are designed for individuals aged 16 or older. By registering, you represent and warrant that you are at least 16 years old.

b. Creating an Account

To use the Services, you must register with a valid email address. You are responsible for providing accurate, truthful, and up-to-date information.

Your account is personal and non-transferable. You may not share it or use it on behalf of others.

3. Use of Services

a. Prohibited Uses

When using the Services, you agree not to:

• Use them for unlawful purposes or in violation of these TCS.
• Interfere with the operation of the Site or Services.
• Share your account credentials with third parties.
• Reverse-engineer, decompile, or attempt to access the source code of the Site.

b. Usage Limits

The Services may have usage limits, such as the maximum number of CVs analyzed per month. Details on these limits will be available on the Site or during registration.

c. Third-Party Services

We may use third-party services, such as OpenAI and Stripe, to provide certain functionalities. While we ensure these providers comply with data protection regulations, we are not liable for their actions beyond our reasonable control.

4. Fees and Payments

Access to the Services may be subject to fees, which will be detailed during registration. All payments are processed through Stripe.

5. Intellectual Property

All software, design, and content of the Site and Services are the property of KUTECH 101 S.L. or its licensors.

User-Generated Content

Any CVs or content generated, adapted, or created using the Services are the sole property of the user. KUTECH 101 S.L. does not claim rights over the CVs or content generated by users and does not restrict their use, reproduction, or distribution.

6. Account Suspension and Termination

a. By Us

We reserve the right to suspend or terminate your account if:

• You provide false or inaccurate information.
• You breach these TCS.

b. By You

You may delete your account at any time via the Site. Upon doing so, you will lose access to the Services, and all associated data will be deleted.

7. Liability and Warranties

The Services are provided "as is." We do not guarantee they will be error-free or uninterrupted. Our liability to you is limited to the amount paid for the Services in the past 12 months.

8. OpenAI and Third Parties

To provide the Services, we use OpenAI as an external data processing provider. OpenAI may process information you enter on the Site, such as your CV or job descriptions. While we take measures to protect your data, you understand that OpenAI operates outside our direct control.

9. Changes to Services and TCS

We reserve the right to modify the Services or these TCS. We will notify you of significant changes via the Site or email.

10. Governing Law and Jurisdiction

These TCS are governed by Spanish law. Any disputes will be resolved in the courts of Barcelona, Spain.
